Disclosure Regarding Collection and Use of Personal Information
VARVEE.com users can post information about themselves and access information about other users who have registered on VarVee.com. The website also will offer users the ability to post content such as photos, videos and other information. VARVEE.com may continue to add additional features and functionality for its users.

IF YOU REGISTER ON VarVee.com, CREATE A PROFILE, POST INFORMATION, REQUEST INFORMATION, OR ENTER ANY CONTESTS OR PROMOTIONS THAT WE OR ANY OF OUR AFFILIATES MAY OFFER, YOU AGREE TO THE TERMS OUTLINED IN THIS POLICY. Required Personal Information
Each person who registers on VarVee.com is required to provide their email address. We require this information so that we can contact our users. In addition, student users are required to provide their first and last names, gender, birth date, high school information, sports interest and in certain cases zip code. We collect this information in order to identify individuals, personalize our service and provide content that is tailored to our users. It is also used to protect other users on the site from potential predators and other dangerous people. However, VARVEE.com's use of school names is not authorized by, associated with or sponsored by the schools. Finally, we require users to select a password to ensure that they are the only person who can control their personal information. You can view or change your information at any time by clicking on the Edit link on your main profile page.
 
 
Optional Personal Information
In addition to the required registration information, you may provide additional information about yourself or others, such as schedules, sports statistics, scores, favorite athletes, photos, videos, and more. You should be aware that VARVEE does try to confirm the accuracy of schedules, sports statistics or scores since this information is largely provided by coaches, but we cannot be held responsible if the information is inaccurate. VARVEE allows you to post this information so that we can make it available to others who wish to learn more about you and to personalize the VARVEE services. We also use this information to better understand our users. Providing this information enhances the VARVEE service for both you and other users, but doing so is completely optional.

Other Collected Information
We may also collect certain non-personally identifiable information (generic information that does not identify you personally) when you visit any of our web pages including the following: 
  • Cookies Information: When you visit VarVee.com, we may send one or more "cookies" (a small piece of data stored on your computer with information about the user) to your computer that uniquely identifies your browser. VARVEE may use both session cookies (which confirm that a user is logged in, and which terminates when you close your browser), and persistent cookies, (which remain after you close your browser, and may be used by your browser on subsequent visits to the site). Persistent cookies can be removed by following your web browser help file directions. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of VarVee.com may not function properly if the ability to accept cookies is disabled.
  • Log File Information: When you use VarVee.com, our servers automatically record certain information that your web browser sends whenever you visit any website. We will only use this information in a manner that is both responsive to your interests and not intrusive.
  • Clear GIFs Information: When you use VarVee.com, we may employ "clear GIFs" (or "web beacons", as they are also known) which are used to track the online usage patterns of our users anonymously (that is, in a non-personally-identifiable manner). In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients.

 

How We Use Your Personal Information
Please note that, except for your email address and password, any information that you provide to us or post on VarVee.com (in your VARVEE profile, on discussion boards, in message areas or on other areas of the website) will be available and can be collected and used by other users on the site.

  • Any of this information, including photos and videos, may be redistributed through the internet and other media channels. Although you may be able to limit public access to certain parts of your information, we strongly recommend not posting any information that you may consider private, sensitive or that you don't want other people to know or to redistribute.
  • VarVee may also collect information about you from other sources, such as newspapers, blogs, instant messaging services, and other users of the VarVee.com service through the operation of the service (e.g., photo tags) in order to provide you with more useful information and a more personalized experience. By using VarVee.com, you are consenting to have your personal data transferred to and processed in the United States.

 

In order to protect your privacy, here are some ideas for you to consider.
VarVee.com has been designed to let your teammates, friends and fans learn more about you, along with the teams and sports you are most interested in. Thus, it's expected that you'll share information about yourself.

  • However, you should avoid posting any personal information that will put you at risk, or that you do not want to share. For instance, you should never post your email, social security number, credit card, or mother's maiden name. You should also avoid posting any information that would allow someone you don't know from actually locating you - like your home phone number or address.
  • Also, some pieces of information are tougher to make decisions about. For example, we recommend NOT posting any personal information like your IM screen-name in public places like comments or discussion boards, even if you have posted that info in your profile, because your profile is more secure and you can control who sees it. Be careful!
  • We recommend posting enough information for your friends, teammates, and fans to be able to celebrate your accomplishments and perspectives on sports in general and your team's performance in particular, and to be able to search for you, but not so much that it would ever put you at risk, because someone could use it to hurt you.
  • Second, of all, use common sense, and always ask people you trust for their advice!
  • Permission: If you are under 18 years of age, you may only use the VarVee Website and VarVee Services in conjunction with, and under the supervision of, your parents or guardians.  We recommend that minors under the age of 18 years of age ask their parents for permission before sending any information about themselves to anyone over the Internet
  • Your Password: With the exception of your parents, never give your password to anyone. If you believe someone might have discovered your password, use the "Forgot your Name or Password?" feature to change your password to something new. And remember, always try to create a password that is easy for you to remember, but very difficult for others to figure out.
  • Online Friends: Although it can be fun and interesting to communicate with people from other high schools who you encounter on VarVee.com, be cautious about people that you've never met in person. After all, they may not be who they say they are. When in doubt, don't become friends with people that you don't know in real life. Doing so could give them additional information about you that you don't want them to have, including access to your profile page, team page, and statistics. As on any site, you should avoid meeting in person people with whom you chat online, until you have independently verified that they are who they say they are and can make sure that you are meeting them in a safe environment - we are thinking of recruiters, but as with anyone you meet in an online setting, the person may not be who they say they are.


Invitations to Friends
If you choose to use our invitation service to tell a friend about our site, we will ask you for your friend's email address. We will automatically send your friend a one-time email inviting him or her to visit the site. VarVee.com stores this information to send this one-time email, to register a friend connection if your invitation is accepted, and to track the success of our referral program. Your friend may contact us at info@VarVee.com to request that we remove this information from our database.

Report and Blocking Members
To become a member of VarVee.com, students, athletes, and coaches must validate that they are above thirteen (13) years of age. Since most of the invitations will be sent to students whose coaches have already listed them as members of a varsity team, or some other team, we are hopeful that this will be effective at providing appropriate security. Although these measures provide a layer of security that most Internet services don't have, it's still not 100% fool-proof. If you come across a member profile that looks suspicious in any way, you should notify us by using the "Report" button at the top of their profile. Never be afraid to report a user for any reason; reporting is anonymous and they will never know who alerted the VARVEE.com Team.

  • VarVee.com works hard to prevent any inappropriate behavior between users and unwanted content associated with you or your profile. If someone harasses you or others, or does anything that makes you feel uncomfortable, use the "Report" link at the top of their profile page to notify theVarVee.com Team.

 

If you ever feel you're in real danger, you should immediately report the matter to your parents, school officials, or local law enforcement. In addition, you should report the member to the VarVee.com Team.

Virus Protection
Occasionally people may misuse VarVee.com to promote their business, or to try to get information about you for fraudulent purposes. Don't respond to such messages and be careful about the external links you click on. You should also make sure you have adequate virus and spyware protection installed on your computer so that if you accidentally click on a harmful link, your computer will alert you.

If you see commercial postings on a personal message board or receive any such personal messages, you should also make sure to report these instances to the VarVee.com staff so that we can remove the content and prevent the person who posted it from repeating his action.

Where such information is used, we generally allow you to specify in your privacy settings that you do not want this to be done or to take other actions that limit the connection of this information to your profile (e.g., removing photo tag links). VarVee is about sharing information with others - friends and people in your networks - while providing you with privacy settings that restrict other users from accessing your information. We allow you to choose the information you provide to friends and networks through VarVee. Our network architecture and your privacy settings allow you to make informed choices about who has access to your information. We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the service, 2) legally required or, 3) permitted by you. For example:

  • Your news feed and mini-feed may aggregate the information you provide and make it available to your friends and network members according to your privacy settings.
  • We may provide information to service providers to help us bring you the services we offer. Specifically, we may use third parties to facilitate our business, such as to host the service at a co-location facility for servers, to send out email updates about VarVee, to remove repetitive information from our user lists, to process payments for products or services, to offer an online job application process, or to provide search results or links (including sponsored links). In connection with these offerings and business operations, our service providers may have access to your personal information for use for a limited time in connection with these business activities. Where we utilize third parties for the processing of any personal information, we implement reasonable contractual and technical protections limiting the use of that information to the VarVee-specified purposes.
  • If you, your friends, or members of your network use any third-party applications developed using the VarVee Platform ("Platform Applications"), those Platform Applications may access and share certain information about you with others in accordance with your privacy settings. You may opt-out of any sharing of certain or all information through Platform Applications simply by letting us know that you do not want to participate - email us at privacy@varvee.com. In addition, third party developers who have created and operate Platform Applications ("Platform Developers"), may also have access to your personal information (excluding your contact information) if you permit Platform Applications to access your data. Before allowing any Platform Developer to make any Platform Application available to you, VarVee requires the Platform Developer to enter into an agreement which, among other things, requires them to respect your privacy settings and strictly limits their collection, use, and storage of your information. However, while we have undertaken contractual and technical steps to restrict possible misuse of such information by such Platform Developers, we of course cannot and do not guarantee that all Platform Developers will abide by such agreements. Please note that VarVee does not screen or approve Platform Developers and cannot control how such Platform Developers use any personal information that they may obtain in connection with Platform Applications. In addition, Platform Developers may require you to sign up to their own terms of service, privacy policies or other policies, which may give them additional rights or impose additional obligations on you, so please make sure to review these terms and policies carefully before using any Platform Application. You can report any suspected misuse of information through the VarVee Platform and we will investigate any such claim and take appropriate action against the Platform Developer up to and including terminating their participation in the VarVee Platform and/or other formal legal action.
  • We occasionally provide demonstration accounts that allow non-users a glimpse into the VarVee world. Such accounts have only limited capabilities (e.g., messaging is disabled) and passwords are changed regularly to limit possible misuse.
  • We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the VarVee service or using the VarVee name, or to prevent imminent bodily harm.   • We may offer stores or provide services jointly with other companies on VarVee. You can tell when another company is involved in any store or service provided on VarVee, and we may share customer information with that company in connection with your use of that store or service.
  • If the ownership of all or substantially all of the VarVee business, or individual business units owned by VarVee, Inc., were to change, your user information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises made in any pre-existing Privacy Policy.
  • When you use VarVee, certain information you post or share with third parties (e.g., a friend or someone in your network), such as personal information, comments, messages, photos, videos, Marketplace listings or other information, may be shared with other users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos, Marketplace listings or other items , this information may become publicly available.

 

Updating or Removing Your Personal Information
You may update or remove from your VARVEE profile any information you post at any time except for your high school information. Complete removal of certain information (such as your name, e-mail address or password) requires terminating your user registration. We provide links to manage your information on your VARVEE profile page. To view your profile page, click on the "My Profile" link on the navigation bar on the side of any VARVEE page.

How We Share Your Personal Information
We will not share your email address or password except (a) if you ask us to send it to you, and you can demonstrate that you are who you say you are, to the best of our reasonable abilities; (b) with your consent; (c) as may be required by law or as we think necessary to protect our company or others from injury (e.g. in response to a court order or subpoena, in response to a law enforcement agency request) ; (d) with other persons or entities with whom we contract to carry out internal site operations or our business activities (for example, sending out a product or a promotional item that you have requested); or (e) notifying you when we make changes to one of our terms of service, this policy or other user agreements.

VarVee may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by VarVee.

Third Party Advertising
Advertisements that appear on VarVee are sometimes delivered (or "served") directly to users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. Use and Disclosure of Non-Personally Identifiable Information
We use the non-personally identifiable information that we collect to analyze how our site is used, improve the design and content of our site and to enable us to personalize your user experience. We will send periodic updates on VARVEE to our registered users that may include updates on new functionality and the announcement of contest winners. We encourage all users of the VarVee.com to be aware of when they leave our website, and to read the privacy policies of each and every website that collects personally identifiable information. This Privacy Policy applies solely to information collected by VARVEE through the VarVee.com.

We may offer email services, contests, sweepstakes, or promotions that are sponsored by or co-sponsored with non-affiliated companies. Based on our agreement with them, these third parties may obtain personally identifiable information that site visitors voluntarily submit to participate in the contest, sweepstakes, or promotion. By using VARVEE and/or these forums, message boards, news groups, and other community tools, you agree that we may do so. Our Commitment to Security
We believe we have in place the appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security and correctly use the information we collect online as well as offline. Whenever personal information is passed on to non-affiliated companies, to the extent practical, we require that they also have in place the appropriate safeguards. We cannot, however, guarantee that they do so.

International Users
If you are visiting VARVEE from a location outside of the United States, your connection will be through and to servers located in the United States and all information you provide will be processed and maintained in our web servers and internal systems located within the United States. By using VARVEE, you authorize the export of personal information to the U.S. and its storage and use as specified above when you provide such information to us.

Applicable Law and Jurisdiction
This policy and our legal obligations are subject to the laws of the State of Colorado and the United States of America, regardless of the location of any user. Any claims or complaints must be filed in the Denver, Colorado.

Special Note for Parents
If you have concerns about the VarVee.com or its services or wish to terminate your child's registration, please email us - privacy@varvee.com . Our site will not knowingly accept personal information from anyone under 13 years old in violation of applicable laws. If you believe that your child under 13 has gained access to our site without your permission, please email us. We have taken commercially reasonable steps to restrict use of this site to those who are at least 13 years old. We do not sell products for purchase by children and all children's products we sell are for purchase by adults only, or with adult permission.

Change of Ownership
In the event of a change in ownership, or a direct merger or acquisition with another entity, we reserve the right to transfer all of VARVEE's user information, including names, and email addresses, to a separate entity. All registered users will be notified of any change in ownership, merger or acquisition of VARVEE's assets by a third party, and may choose to modify any of their registration information at that time.

Changes to this Policy
Because our business needs may change over time, we reserve the right, at our discretion, to change, modify, add, or remove portions from this policy at any time. If at any time in the future we plan to use your personally identifiable information in a way that differs from this policy, we will revise this policy as appropriate. Your continued use of VARVEE following the posting of any changes to this policy means you accept such changes. This policy is effective August 11, 2007.
